When you hire a vendor to help with HIPAA compliance (risk analysis, security assessment, “HIPAA report”), what are the most common mistakes they make, and what are the red flags you can use to spot a weak or misleading deliverable fast?
The biggest HIPAA-vendor reporting mistakes fall into three buckets: wrong scope, wrong standards, and no proof. A solid deliverable should clearly map to what the HIPAA Security Rule actually requires (especially documented, accurate, and thorough risk analysis), show your true ePHI environment (systems, data flows, users, vendors), and produce actionable remediation you can execute and evidence later. HIPAA doesn’t require a specific template for risk analysis, but it does require you to document it and to make it accurate and thorough for the confidentiality, integrity, and availability of ePHI. That’s why many vendor reports fail in practice: they look polished, but they’re not anchored to your real environment or to HIPAA’s actual expectations. And regulators repeatedly flag missing/insufficient risk analysis as a core compliance breakdown in enforcement.
The Red Flags Checklist (vendor report edition)
A) Scope & Inventory red flags (the report isn’t about your ePHI reality)
- No ePHI asset inventory: no list of systems/apps/devices that create, receive, maintain, or transmit ePHI (EHR, email, imaging, patient portal, backups, endpoints, file shares, MDM, ticketing, etc.). This is a common “not thorough” failure mode.
- Missing data flows: no diagram or narrative showing where ePHI moves (clinic <-> lab <-> billing <-> clearinghouse <-> cloud storage <-> MSP).
- “We scanned your network” = “We did HIPAA”: vulnerability scans can be useful, but they’re not a HIPAA risk analysis by themselves. HIPAA risk analysis is broader than CVEs.
- No locations: ignores remote work, home access, mobile devices, satellite clinics, third-party hosting, or offsite backups.
- No vendor/BA coverage: doesn’t address business associates that touch ePHI (IT support, transcription, cloud hosting, eFax, portal vendor, etc.).
What “good” looks like: an explicit system inventory and ePHI data flow section that clearly defines boundaries and includes cloud, endpoints, and third parties.
B) “Standards laundering” red flags (they imply compliance without mapping to HIPAA)
- They cite frameworks but don’t map to HIPAA provisions. Referencing NIST is fine, but the report should still map findings to HIPAA Security Rule expectations and documentation.
- No mention of the Security Management Process (risk analysis, risk management, administrative safeguards, and other required elements) or it’s treated as “optional.”
- Confuses “addressable” with “not required.” HIPAA “addressable” safeguards still require a justified decision and documentation, not a shrug. (If the report never addresses how decisions are documented, that’s a tell.)
- Over-reliance on a “HIPAA certificate” badge: certifications can be marketing; HIPAA compliance is demonstrated through controls, evidence, and governance.
What “good” looks like: a crosswalk to HIPAA Security Rule requirements and/or a recognized implementation guide (NIST HIPAA implementation guidance) with clear control ownership and evidence expectations.
C) Risk methodology red flags (they didn’t actually analyze risk)
- No defined scoring model (likelihood/impact or equivalent), or the scoring exists but is never explained.
- Findings are generic (“improve security awareness,” “use strong passwords”) with no tie to specific systems, users, or workflows.
- No “reasonable and appropriate” rationale: HIPAA expects safeguards appropriate to your environment; the report should show why the risk level is what it is and what mitigations fit your reality.
- No “CIA” thinking: if availability and integrity are never discussed (only confidentiality), it’s usually shallow. HIPAA risk analysis is explicitly CIA-focused.
- No “changes since last time”: risk analysis isn’t a one-and-done. If the report doesn’t capture material changes (new EHR module, new portal, MFA rollout, new MSP, cloud migration), it won’t hold up operationally.
What “good” looks like: documented risk levels and clear corrective actions list (HIPAA expects the output to feed risk management).
D) Evidence & auditability red flags (you can’t prove anything later)
- No documentation clause awareness: HIPAA requires documentation and retention of required policies/procedures and actions. If the report doesn’t produce evidence artifacts or at least an evidence plan, it’s weaker.
- No remediation plan you can run: missing owners, timelines, dependencies, and prioritization.
- No proof of testing/verification: encryption is “assumed,” backups are “assumed,” MFA is “recommended,” but nothing is verified (configs, screenshots, logs, exports, policies, tickets).
- CAP readiness gap: if an incident happens, you’ll need to show what you knew, when you knew it, and what you did. Weak reports fail here, and enforcement actions routinely emphasize risk analysis deficiencies.
What “good” looks like: a remediation backlog with priority, rationale, and “what evidence will exist when complete.”
E) Vendor overreach / wrong-regime red flags (especially with health apps & non-HIPAA vendors)
- They treat HIPAA as the only privacy regime that matters. Many health apps and tracking technologies aren’t HIPAA-covered, but they may trigger other enforcement (Federal Trade Commission health data enforcement). If your vendor’s report ignores non-HIPAA exposure when relevant (tracking pixels, SDK sharing, ad tech), that’s a blind spot.
What “good” looks like: clear scoping: what is HIPAA-covered, what is not, and what parallel obligations exist.
The “5 questions” to ask before accepting the report (fast validation)
- Show me your ePHI inventory and data flows. If they can’t, the analysis likely isn’t “thorough.”
- Point to where you documented risk levels and corrective actions. That’s core output.
- What evidence did you review (configs, logs, policies, tickets), and what did you assume?
- What changed since last assessment, and how did that change the risk posture?
- Map your findings to HIPAA Security Rule expectations (or a HIPAA-focused implementation guide).
What to put in your RFP / SOW so you don’t get a “pretty PDF” again
- Required deliverables: system inventory, ePHI data flows, scoring methodology, risk register, remediation backlog, evidence plan
- Explicit mapping: HIPAA Security Rule risk analysis requirement, and documentation expectations
- Interview requirements: IT, clinical workflow rep, billing, and vendor management (so scope is real)
- Verification expectations: what they must validate vs. what can be self-attested
- Update clause: reassessment triggers (EHR change, cloud migration, ransomware event, new BA, etc.)
